However, service availability and quality may be affected by various factors, including but not limited to technical issues, network conditions, customer location, or external interferences. Suniway does not guarantee that the service will be available at all times or that the service will meet the customer's specific needs or expectations.
By submitting an application for broadband installation, you acknowledge that installation times are subject to availability and may be delayed due to unforeseen circumstances, including weather conditions, technical difficulties, or access issues at the installation site. Suniway is not responsible for any delays in installation and any associated losses, damages, or inconvenience caused to the customer.Please keep your items properly during the installation process and supervise the entire installation process. Suniway is not responsible for any items lost during the installation process.
The broadband service provided by Suniway is intended for lawful and reasonable use only. Suniway is not liable for any misuse of the service by the customer, including but not limited to engaging in illegal activities, excessive bandwidth usage, or activities that may disrupt the network or infringe upon the rights of other users. Customers are solely responsible for ensuring that their use of the service complies with all applicable laws, regulations, and Suniway's acceptable use policies.
Suniway is not liable for any direct, indirect, incidental, or consequential damages resulting from the use or inability to use the service. This includes, but is not limited to, loss of data, business interruption, loss of profits, or any other commercial damages. Suniway’s liability, if any, shall be limited to the amount paid by the customer for the service during the period in which the damage occurred. Suniway disclaims all warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.
Suniway may provide access to third-party websites, content, or services as part of its broadband offering. These external resources are provided for convenience only, and Suniway does not endorse, guarantee, or assume responsibility for the accuracy, reliability, or legality of any information, products, or services offered by third parties. Customers access and use these external resources at their own risk. Suniway is not liable for any loss or damage resulting from the use of third-party websites or services.
Customers are responsible for ensuring that their use of the service complies with all applicable laws, regulations, and Suniway's terms and conditions. Customers must maintain the security and confidentiality of their account information, including passwords and access credentials, to prevent unauthorized access to the service. Customers are also responsible for any activities conducted under their account, whether authorized or not. Any misuse of the service, including but not limited to sharing access with unauthorized users, may result in the suspension or termination of the service without notice.
Suniway may conduct scheduled maintenance or upgrades to its network and services, which may result in temporary service interruptions. Suniway will make reasonable efforts to provide advance notice of such interruptions but cannot guarantee that all interruptions will be communicated in advance. Additionally, Suniway is not responsible for any unplanned service interruptions caused by factors beyond its control, including but not limited to power outages, natural disasters, or third-party actions. Customers agree that Suniway shall not be liable for any damages, losses, or inconvenience resulting from service interruptions.
Suniway may implement a Fair Use Policy to ensure that the service is used in a manner that is fair to all customers. This policy may include limits on bandwidth usage, data transfer, or other resources to prevent excessive use that may negatively impact the network or other users. Customers exceeding these limits may be subject to additional charges, reduced service speeds, or other measures to ensure fair usage. Suniway reserves the right to modify or enforce the Fair Use Policy at its discretion.
Suniway reserves the right to amend or update these terms and conditions at any time. Customers will be notified of any significant changes through email, website notifications, or other means. Continued use of the service following such updates constitutes acceptance of the new terms. If a customer does not agree to the updated terms, they may terminate the service in accordance with Suniway's termination policy.
This disclaimer and the use of Suniway's services shall be governed by and construed in accordance with the laws of the Philippines. Any disputes arising out of or relating to this disclaimer or the services provided by Suniway shall be subject to the exclusive jurisdiction of the courts of the Philippines. Customers agree to submit to the jurisdiction of such courts for the resolution of any disputes.
Customers agree to indemnify, defend, and hold harmless Suniway, its affiliates, officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, or expenses, including reasonable attorneys' fees, arising out of or in connection with the customer's use of the service, breach of this disclaimer, or violation of any applicable laws or regulations.
The failure of Suniway to enforce any provision of this disclaimer shall not be construed as a waiver of such provision or the right to enforce it at a later time. No waiver of any provision of this disclaimer shall be effective unless it is in writing and signed by an authorized representative of Suniway.
