Broadband Internet Service
You agree to use the Service and Equipment only for lawful purposes. Without limitation, you agree not to use the Service and Equipment for transmitting or receiving any communication or material of any kind which in SUNIWAY sole judgment the transmission, receipt or possession of such communication or material (i) would constitute a criminal offence, give rise to civil liability, or otherwise violate any applicable law or (ii) encourages conduct that would constitute a criminal liability, or otherwise violate any applicable law [ the uses described in clauses (i) and (ii) above are collectively referred to as “Prohibited Uses”].
SUNIWAY reserves the right to terminate your service immediately and without advance notice, if SUNIWAY has proof that you are using the Service and Equipment for a Prohibited Use.
Upon any such termination, you shall continue to be responsible for the full month’s charges to the end of the current term, including without limitation unbilled charges, plus a disconnect fee, all of which immediately become due and payable and may at SUNIWAY discretion be immediately charged to you.
You are liable for any and all use of the Service and/or Equipment by yourself and by any person making use of the Service or Equipment provided to you and agree to indemnify and hold harmless SUNIWAY against any and all liability for any such use.
If SUNIWAY has proof that you have used the Service or Equipment for a Prohibited Use, SUNIWAY may forward the objectionable material, as well as your communication with SUNIWAY and your personally identifiable information to the appropriate authorities for investigation and prosecution and you hereby consent to such forwarding.
VoIP Services
You agree to use the Service and Equipment only for lawful purposes. Customer Responsibility for Local Area Network (LAN)
The Customer accepts that the Supplier is not in the business of providing LAN services to its customers
If during the lifetime of the Customer with the Supplier, the Customer lodges complaint which is investigated and determined to be attributable to the LAN issue, the Customer accepts and agrees to take responsibility for resolving such LAN issue
Where the Supplier has the expertise in resolving the determined LAN issue and where Customer agrees with the Supplier that Supplier provides such LAN service, the Customer accepts and agrees to pay the required fee, as communicated by the Supplier before starting work
Customer Responsibility for Uninterrupted Power Supply
It is a requirement that the equipment to be installed by SUNIWAY at the premises of the Customer shall be connected and powered all the time. The customer thus accepts and agrees to provide uninterrupted power supply to the installed equipment all the time.
Customer Responsibilities For Service Installations
Customer accepts responsibilities that prior to the installation of any service that requires connectivity (access services) such as the Internet, Wide Area Network, and more, that they shall arrange and provide access or private right of way and power for SUNIWAY to establish the connection and install any necessary equipment either on the mast, rooftop, ground or underground, all at the customer’s own expense.

Hiring of Scaffold
The Customer accepts that the Supplier does not use a scaffold as one of its operational equipment
Where it is determined during the survey that the access to the place of installation of equipment shall require a scaffold, the Customer accepts and agrees to provide the scaffold for the installation
Alternatively, where the Customer agrees with the Supplier to hire a scaffold for the installation of equipment, the Customer accepts and agrees to pay for the hiring fee on the day of hire
