2. Definitions
- "Customer": The individual or entity that subscribes to the Service.
- "Service": The broadband internet service provided by Suniway.
- "Equipment": Any devices or hardware supplied by Suniway for the purpose of accessing the Service.
3. Service Provision
- Eligibility: The Service is available to individuals or entities located in Suniway's coverage areas.
- Service Activation: Service will be activated following a successful installation at the customer’s premises.
- Service Limitations: Service quality may be affected by factors such as location, equipment, and network conditions.
4. Use of Service
- Permitted Use: The Service is intended for personal or business use only. Any unlawful use is strictly prohibited.
- Prohibited Activities: Activities such as hacking, spamming, or distributing malware using the Service are forbidden.
- Bandwidth Usage: Customers must adhere to any bandwidth usage limits applicable to their plan.
5. Customer Responsibilities
- Account Security: Customers are responsible for maintaining the confidentiality of their account information.
- Equipment Care: Customers must ensure that all Suniway-provided equipment is used properly and returned in good condition if required. Exceptions include buyout of equipment.
- Payments: Customers agree to pay all applicable fees for the Service, including installation and monthly charges.
- Acceptable Use: Customers must use the Service in accordance with all applicable laws and regulations. Any misuse, including illegal activities, is strictly prohibited.
- Reporting Issues: Customers are responsible for promptly reporting any issues with the Service or equipment to Suniway’s customer support.
- Legal Compliance: Customers must comply with all relevant local, national, and international laws, including those related to data protection and privacy.
6. Billing and Payment
- Billing Cycle: The billing cycle is monthly, and payment is due on the specified due date.
- Late Payments: Late payments may result in service suspension and additional fees.
- Disputed Charges: Any disputes regarding billing must be raised within 30 days of the charge.
7. Equipment
- Ownership: Suniway retains ownership of any equipment provided unless otherwise purchased by the customer.
- Maintenance: Customers are responsible for the proper maintenance of the equipment.
- Return of Equipment: Upon termination of Service, customers must return the equipment or face additional charges.
8. Service Suspension and Termination
- Suspension: Suniway may suspend the Service for non-payment, breach of this Agreement, or other valid reasons.
- Termination by Customer: Customers may terminate the Service by providing notice as specified in their plan.
- Termination by Suniway: Suniway reserves the right to terminate the Service for breach of this Agreement or other valid reasons.
9. Privacy Policy
- Data Collection: Suniway collects personal data in accordance with its Privacy Policy.
- Data Use: Personal data will be used to provide and improve the Service, and for other purposes as described in the Privacy Policy.
- Data Protection: Suniway implements measures to protect customer data from unauthorized access.
10. Liability
- Limited Liability: Suniway is not liable for any indirect, incidental, or consequential damages arising from the use of the Service.
- Service Interruptions: Suniway is not responsible for interruptions to the Service caused by factors beyond its control.
- Indemnification: Customers agree to indemnify Suniway against any claims arising from their use of the Service.
11. Dispute Resolution
- Negotiation: Any disputes arising under this Agreement will first be resolved through negotiation.
- Arbitration: If negotiation fails, disputes may be resolved through arbitration in accordance with local laws.
12. Governing Law
This Agreement is governed by the laws of the Philippines.
13. Amendments
- Right to Amend: Suniway reserves the right to amend this Agreement at any time.
- Notification: Customers will be notified of any amendments, which will take effect upon continued use of the Service.
